Terms of Service

All sales are final once the project is completed and delivered.

♡ Deposit Requirements
A 50% non-refundable deposit is required before work begins. This secures your project and covers initial design and preparation time.

♡ Final Payment
The remaining 50% balance is due upon completion and before final files are delivered. I do not accept full payment upfront, only the 50% deposit is required to start.

♡ Rejected or Unused Graphic Material
I reserve the full right to reuse, resell, repurpose, or revise any rejected or unused concepts for future projects, promotions, resale (such as pre-made graphics), or inclusion in my design portfolio.

Any design concepts, drafts, or variations that are rejected, not selected, or not included in the final approved design remain the intellectual property of the designer (Toxxic Rhiannyr).

This includes but is not limited to: logos, icons, layout arrangements, typographic styles, color palettes, and any other graphic elements presented during the course of the order.

Clients do not have any ownership or exclusive rights to unused designs, nor may they request exclusivity over unused concepts unless a separate agreement is made in writing and may incur an additional fee.

If a client wishes to purchase full rights to all concepts presented, including rejected or unused versions, a buyout fee can be discussed prior to project completion.

♡ Gift Order Policy
I do not accept orders intended as gifts from a third party. All custom projects must be placed and paid for directly by the client or their authorized management team. This ensures clear communication and a smooth design process.

♡ Forms of Payment
For Second Life customers, preferred method is Lindens. I will however accept CashApp, Paypal, Zelle or Venmo. If you are using Paypal as a form of payment, a invoice will be sent to your email, designated for a Service transaction.

♡ Cancellation / Refund Policy
If a project is canceled before work begins, a refund may be issued minus any processing fees. All payments made for graphic design services are final and non-refundable once work has commenced. If a client chooses to cancel after work has begun, no refunds will be issued. Absolutely no refunds are issued once the final product has been delivered.

♡ Abandoned Projects
A project shall be considered abandoned after 30 consecutive days have passed since the last communication received from the Client. In all abandoned projects, deposits are forfeited without option for reclamation. Any renewal of the project after termination will require a new agreement, fee schedule and deposit.

♡ Turnaround Times
Completion times vary based on the order details and my workload. Large orders are typically stretched out over a 4-8 week time frame. Smaller orders can be processed within a week.

♡ Rush Orders
Rush orders are considered with additional fees.

♡ DMCA / Intellectual Property
Unauthorized usage of ANY graphic design previews showcased in my portfolio is strictly prohibited. Any individual found using this material without a valid purchase may face Copyright Issues and DMCA action. This prohibition extends to file sharing with alternate accounts (alts) and friends, especially concerning full permission purchases via the SL Marketplace.

♡ Zero Tolerance
I reserve the right to refuse working with you without explanation. I tend to mirror the energy given to me, so please be polite and respectful of my time and I will reciprocate that back to you.

♡ Communication
I only use Second Life and Discord for communication.

♡ Copyright / Trademarks
Simply put, I do not replicate other people’s work. Please refrain from requesting me to recreate anything from another brand, whether inside or outside of SL. I will not design logos that mimic established brands like Chanel, Gucci, Nike, or Disney. My dedication is to provide original and unique designs for each client, and I work diligently to make your project stand out without relying on others’ work. Asking me to copy someone else is against my principles, and I will decline to work with you altogether if this issue is pressed.

I, Toxxic Rhiannyr, abide by Linden Lab TOS, Content Creators TOS and copyright laws. Works created will NOT include the illegal use of RL brand logos, images, celebrity or character art without having the appropriate and explicit permission from the copyright owner(s). Toxxic retains the right to display designs in portfolios and social media, unless exclusion is explicitly requested and agreed upon in writing with the Client.

♡ Privacy Policy
I am committed to protecting your privacy and will conduct business in accordance. Emails & Discord names may be collected for future advertising of my services but never shared publicly.

♡ Right of Refusal
I will not include designs, text, images or other data which it deems to be immoral, offensive, obscene or illegal. All advertising material must conform to all standards laid down by all relevant advertising standards authorities.

♡ Disclaimer
I reserve the right to hire services of sub-contractors, agents and suppliers and any work, content, services and usage is bound by their Terms and Conditions. The purchasing of licensed material such as fonts, vector elements, patterns, backgrounds or shapes may apply to your order. If such elements are needed, written consent to purchase said elements will be issued to you.

♡ Third Party Attributes
I am a premium subscriber to Envato Elements, Freepik, Creative Fabrica and Shutterstock. Additionally, I acquire licensed materials through Creative Market, Etsy, and Deviantart for use in my commercial projects. I take careful measures to ensure that the commercial licenses for these materials are legitimate and royalty-free.

♡ AI – Generated Content
I reserve the right to utilize AI-generative content inside my work with the assurance that its kept ethical, legal and professional standards are maintained. AI-generated graphic content must not contain offensive, discriminatory, or inappropriate material. Respect for intellectual property rights must be upheld. AI-generated content should not replicate or closely mimic copyrighted material unless proper permissions are obtained. All AI-generated content should be clearly labeled as such to maintain transparency with clients, stakeholders, and the public. AI-generated graphics should complement, not replace, human creativity and expertise.

♡ No Call, No Show Policy

Your time and mine are valuable. If you fail to attend a scheduled consultation or project meeting without prior notice, it will be considered a No Call, No Show.

If you do not show up and fail to notify me at least [8 hours] in advance, you will be required to pay a $20 rescheduling fee before booking another appointment.
After two No Call, No Shows, I reserve the right to decline future projects.
Emergencies happen—please communicate as soon as possible if you need to reschedule to avoid the fee.

♡ Platform-Based Pricing & Usage Disclaimer

Pricing varies across platforms due to differences in asset usage, distribution, profit potential, and legal considerations.

Projects created for platforms such as Second Life and other virtual environments are priced differently than work intended for real-world or multi-platform use. Real-world branding and design may involve commercial printing, broader distribution, higher profit margins, and the ability to register copyrights or trademarks, which increases both the scope and responsibility of the work.

Additionally, print-intended design is created using different technical standards than web or in-world assets, including color management, resolution, file preparation, and reproduction requirements.

For these reasons, pricing is not interchangeable between platforms and is determined based on intended use, platform, and scope of distribution.
